Senate flips blue, handing Warren the gavel over crypto's stalled market-structure bill
Democrats won the incoming Senate, the AP says, after Josh Turek took Iowa. That puts Elizabeth Warren in line to chair Senate Banking, replacing Tim Scott — and to steer the CLARITY Act, the crypto market-structure bill already stuck at the Senate floor.
The Senate is changing hands, and that reshuffles who gets to write the rules for crypto. Democrats won control of the incoming chamber, the Associated Press reported, after Josh Turek beat Republican Ashley Hinson in Iowa. Fox News' Decision Desk separately projected Democrats would land at least 51 seats — a majority.
The AP called Turek's win at 11:35 p.m. ET on Nov. 3. He takes the seat Republican Joni Ernst is leaving. The call settles which party runs the chamber, not the final count in every race.
That matters most for Elizabeth Warren. The top Democrat on Senate Banking is positioned to take the gavel from Republican Chairman Tim Scott, pending leadership decisions in the new Senate. Warren voted against the CLARITY Act's procedural push in September and has pushed for harder limits on presidential crypto conflicts of interest.
CLARITY — H.R. 3633 — would build a federal framework for digital commodities, covering oversight of exchanges, brokers and dealers, per the Congressional Research Service. The House passed it 294–134 in July 2025. Senate Banking reported a substitute version on June 1, 2026. The September vote wasn't about passing the bill: it was a bid to end debate on taking it up, and it failed 49–50. A motion to reconsider is the last thing on the record.
So the election didn't kill the bill or restart it — CLARITY already cleared Banking and is stuck at the floor. A Democratic-led committee could shape a later version, but nothing about Tuesday's result says which text could actually pass.
Banking isn't the only player here. Agriculture, chaired by Republican John Boozman with Democrat Amy Klobuchar as ranking member, is in the mix too. Boozman told Agri-Pulse he and Cory Booker had 'really worked hard on this crypto thing'; Booker said he'd be 'excited and privileged' to chair it, though that succession only opens up if Klobuchar leaves to become Minnesota governor — a conditional path, not a done deal.
