Democrats Take the House, Grab the Gavel Over Crypto Bills
Democrats won the U.S. House, the AP projected Nov. 4, handing them unified control of Congress alongside their Senate win. That puts the gavels of the two committees that shaped the CLARITY Act in Democratic hands — and CLARITY is still stuck on the Senate floor.
Democrats have won control of the incoming U.S. House, the Associated Press projected on Nov. 4, adding the lower chamber to their Senate victory and putting both legislative agendas under Democratic leadership. The AP said its race calls rely on vote results and other election data showing trailing candidates cannot close the gap, with official certification typically arriving weeks later. The House projection extends the Senate-control development The Defiant previously reported.
Why crypto should care: the incoming majority takes over House Financial Services and House Agriculture — the two committees that handled the CLARITY Act. Chairs decide which proposals get hearings and amendment votes, which hands Democrats real leverage over future market-structure legislation and oversight of presidential crypto interests.
The bill itself hasn't moved. CLARITY, H.R. 3633, remains stalled at the Senate floor. The House passed it 294–134 on July 17, 2025, Senate Banking reported a substitute on June 1, 2026, and on Sept. 15 senators rejected cloture — the move to end debate — on taking it up, 49–50. That wasn't a final-passage vote, and the latest recorded action is still Sen. Thom Tillis's motion to reconsider that same day. The election changed the leadership, not those steps.
There's a clock running. If CLARITY isn't enacted before this Congress ends, it has to be reintroduced with a new number and start the legislative slog over, according to the Law Library of Congress.
Democratic control doesn't mean one crypto position. Maxine Waters, the top Democrat on House Financial Services, argued after the September setback that Congress should curb presidential crypto profiteering before passing more crypto legislation. House Agriculture's ranking Democrat, Angie Craig, called the House-passed bill “a step in the right direction” in July 2025 while demanding stronger conflict-of-interest guardrails. Neither statement settles who will chair the incoming committees.
The oversight agenda already has a starting point. In an April 2025 letter, Waters and Sen. Elizabeth Warren asked the SEC to preserve and hand over records concerning World Liberty Financial and communications with the Trump family, seeking information on possible influence over regulatory decisions. With committee control, Democrats can set hearing agendas instead of just requesting documents from the minority. In the Senate, majority control gives them scheduling influence, but the supermajority needed to end debate on most legislation stays in place, as the Congressional Research Service explains. CLARITY, per CRS, would establish a federal regulatory framework for digital commodities, covering exchanges, brokers and dealers.
