Democrats Take Both Chambers, and the Crypto Rulebook With Them
Democrats are projected to win the House and Senate in the Nov. 3 midterms, handing them control of congressional crypto legislation when the new Congress sits in January. The flip comes weeks after the Digital Asset Market Clarity Act died on a 49-50 Senate cloture vote.
Democrats are projected to control both chambers of Congress after the Nov. 3 midterms, according to tokenpost.com. Projections put them past 218 House seats — the majority threshold — and at least 54 seats in the 100-member Senate. State certifications are still pending, so those totals aren't locked in yet.
The win lands the new majority in charge of crypto legislation the moment lawmakers convene in January. That means Democrats pick committee leaders, set hearing agendas and decide which bills actually get floor time. What they haven't done is say what their crypto priorities are, or whether a reworked market-structure bill is even on the table.
The timing is pointed. On Sept. 15, the Senate voted 49-50 against invoking cloture on a motion to proceed to H.R. 3633, killing any chance of debate on the Digital Asset Market Clarity Act. That bill would have built a federal framework for offers and sales of digital commodities, with the SEC and CFTC splitting the oversight.
So the market-structure push that stalled out under the old Congress now belongs to a new one. President Donald Trump remains in office, and the fresh Congress gavels in come January.
One thing the election didn't do: enact any crypto law or rewrite agency rules. Those fights still have to run through the Capitol — starting with whoever Democrats tap to chair the committees that write them.
