Gibran Diploma Challenger Asks DPR to Use Right to State Opinion
Ahmad Khozinudin, a lawyer who challenged Vice President Gibran Rakabuming Raka's education credentials, took his case to Indonesia's House of Representatives on Monday. He asked lawmakers to invoke Articles 7A and 7B of the 1945 Constitution and the right to state an opinion, arguing Gibran should be removed if he does not meet constitutional requirements.
Ahmad Khozinudin, a lawyer for the team Advokasi Penegak Etika, Moral, dan Integritas Bangsa, submitted a formal audiensi request to Indonesia's House of Representatives (DPR) on Monday, seeking to present his reading of the Constitutional Court's legal considerations on Vice President Gibran Rakabuming Raka's high school equivalency diploma. He was accompanied by the Aliansi Rakyat Menggugat and the lawyers' group Ormas Pengacara Jawara Bela Umat at the DPR building in Jakarta.
Khozinudin said the group was eventually received by the legislature's public relations section, but noted that they had trouble getting past the entrance. He described the difficulty as one of several points of note from the visit.
In his submitted documents, Khozinudin asked lawmakers to activate the constitutional mechanisms set out in Articles 7A and 7B of the 1945 Constitution, framing it as a follow-up to the legal reasoning in Constitutional Court decision No. 01/PHPU.PRES-XXIV/2026, which addressed the educational requirements for a vice president. He also requested that the DPR use its right to state an opinion (Hak Menyatakan Pendapat) in a process to remove Gibran from the vice presidency if he is proven not to meet constitutional requirements.
Khozinudin said he is pursuing two legal tracks. On the criminal side, he pointed to Surat Keterangan Penyetaraan No. 9149/D.D1/KS/2019, dated 6 August 2019, claiming the certificate has no object serving as the basis for the equivalency and therefore contains incorrect information or a forged document — a matter he says has already been reported to Bareskrim Polri. On the state-administration side, he argued the equivalency letter does not comply with Article 169 letter r of the Election Law, saying the phrase 'other equivalent schools' was equated by the certificate even though no diploma, certificate or school record existed as the object.
He argued the DPR does not need to pursue a right of inquiry (hak angket) because, in his account, the Constitutional Court has already carried out the investigation and found that the vice president no longer meets the requirements. He said the DPR holds the legal standing to bring the matter forward, and that it should be followed by an MPR session with two agenda items: declaring the dismissal and naming a replacement.
Khozinudin previously filed a complaint with Bareskrim Polri over the alleged criminal falsification of the education equivalency certificate used when Gibran registered as a vice-presidential candidate in the 2024 election. He said the criminal test relies on Article 391 paragraphs 1 and 2 of the Criminal Code on document forgery, with paragraph 1 directed at the Ministry of Primary and Secondary Education (Kemendikdasmen) as the issuer and paragraph 2 at Gibran as the user of the allegedly false document. He described the step as a way to examine the certificate for what he considers incorrect information or forgery.
